Notice of Congregational Meeting                                                                May 17, 2022

A congregational meeting of the members of St. David’s Presbyterian Church, operating as Mountainview Church, will be held on Sunday May 29, 2022 following the morning worship service. The purpose of the meeting is to seek congregational approval of the attached Declaration of Trust.


-          The Land Owner Transparency Act BC was enacted effective November 30, 2020

-          It formed part of the BC government’s 30 point housing affordability plan

-          It was enacted to combat money laundering in the BC real estate industry, and to expose “hidden land ownership”

-          The Act requires that the ultimate ownership of land held through corporations, partnerships and trusts be disclosed through a transparency declaration in a Land Owner Transparency Register

-          Ownership of church lands within the Presbyterian Church in Canada is governed by the Book of Forms, which requires congregations to elect Trustees to execute legal documents with respect to the church lands only as approved by the congregation

-          Such Trustees operate in accordance with the terms of a Declaration of Trust ratified by the congregation

Current Situation

-          Mountainview Church is required to file a transparency declaration through a lawyer by November 30, 2022

-          Failure to comply can result in significant financial penalties

-          We require an updated Declaration of Trust for our transparency declaration

Next Steps

-          Seek congregational approval for the Declaration of Trust on May 29

-          Seek endorsement of our Declaration of Trust by the Presbytery of Kamloops

-          Complete the transparency declaration (register our Declaration of Trust, property ID number and street address) and have it filed by our lawyers, DeJager Volkenant Barristers & Solicitors, prior to November 30
